Air Pollution Legislation
Householders should note that 'backyard burning' of garden (or any other type of) waste can be construed to be a nuisance under the Act and that enforcement action can be taken by Limerick City Council accordingly.
The Air Pollution Act (Marketing, Sale, Distribution and Burning of Specified Fuels) Regulations, 2012 (S.I. No. 326 of 2012), have consolidated all previous applicable regulations made under the Air Pollution Act.
It is an offence under Section 6 of these regulations for the occupier of any private dwelling in Limerick City to burn bituminous ("smoky") coal.
Furthermore, it is an offence to market, sell or distribute, in Limerick City, any fuels specified in the regulations.
